3. DATA SUBJECT RIGHTS

Telemàtic IT Solutions, S.L. informs users that they may exercise their rights of access, rectification, restriction, erasure, portability, objection to the processing of personal data, and the right not to be subject to automated individual decision-making, including profiling, before the Data Controller, as well as the right to withdraw any consent previously granted.

• Right of Access: This is the user’s right to obtain confirmation as to whether their data is being processed and, if so, to access the specific personal data being processed and information relating to the processing activities (purposes, legal basis, retention periods, disclosures, source of the data, etc.).
• Right to Rectification: This is the right of the data subject to have inaccurate or incomplete data corrected. In relation to the website, this right may only be exercised with respect to information under the website’s control, such as the removal of comments published on the website itself, images, or web content containing the user’s personal data.
• Right to Restriction of Processing: This is the right to request that the purposes of processing originally intended by the Data Controller be limited in certain circumstances.

• The written request submitted by the holder of the personal data (data subject) requesting the exercise of their rights must take the following into account:
  • They must provide reliable proof of identity and, in the event of any doubts regarding the identity of the applicant, they may be requested to rectify the request (e.g., by providing additional information such as their ID number, a copy of their ID document, the email address previously provided, etc.).
  • The request may be submitted by a legal or voluntary representative, provided that they are duly identified and authorized by the data subject (by means of express authorization from the data subject to exercise the strictly personal rights regulated under personal data protection regulations).
  • The request must clearly specify the request being made (the right or rights the data subject wishes to exercise). If no specific processing activity is referenced, a response will be provided regarding all processing activities involving their personal data. If information is requested about a specific processing activity, only information relating to that activity will be provided. If the request is made by telephone, the data subject will be instructed to submit it in writing and will be informed of the procedure and the address to which it should be sent. Information will never be provided over the telephone.
